Who is affected

Attention all businesses that sell or handle food in New York City! Starting from March 1, 2024, if you have five or more locations in the city, you must put your waste in a bin with a secure lid when you put it on the curb. This rule applies to all food-related businesses, including catering, food manufacturing, food service, and food preparation businesses, food wholesalers, and retail food stores. This also includes businesses that have the same name, are under common ownership, or are under a franchise agreement with the same franchisor. 

However, if your waste is collected from a loading dock, then you do not have to follow this rule. It is important that all food-related businesses comply with this rule to keep the city clean and safe.

What types of waste

When you put your garbage out for collection, make sure it’s in a bin with a tight lid. This applies to food waste, food-soiled paper, and any other waste that is not recyclable (like metal, glass, plastic, or clean paper and cardboard). You don’t have to separate your garbage from your food waste, just make sure it’s all in a bin with a secure lid. This will help keep your neighborhood clean and prevent animals from getting into your garbage.

When to set out

ALL business:

  • If using bins with secure lids, place at the curb up to 1 hour before closing.
  • If using bags, place at the curb after 8:00 PM.
